Agreements or cooperations between companies that restrict competition are illegal and can affect any company, regardless of its size: Companies that sell their services via sales partners or cooperate with commercial agents must comply with antitrust regulations. Dominant market players shall be very caution in their practices. Antitrust law could also play a role in a M&A project.
Unfair competition law
Unfair competition law prohibits unfair commercial practices that give a company an unfair advantage over a competitor. In advertising and marketing in particular, care must be taken to avoid misleading statements (keyword ‘greenwashing’). However, unfair competition law also provides protection if employees are poached by using reprehensible methods.
